Who administers the Longshore and Harbor Workers Compensation Act (LHWCA)?
The Secretary of Labor administers the LHWCA. The Secretary is empowered to fix rules and regulations, appoint assistants, and make expenditures as necessary for the administration of the Act.
When a dispute arises between the parties, either the employer and the employee, or the employee and the insurance carrier, it is the duty of the District Director of the Department of Labor to try and handle these disputes on an informal basis. If it becomes apparent that no agreement can be reached, or a party requests, the District Director or his assistant must transfer the case to an Administrative Law Judge's office for a formal hearing. The employee may not directly sue his employer in any other setting, as the exclusive remedy is compensation benefits under LHWCA.
