What about malpractice by the ship's doctor?

The carrier is not
strictly liable to the passenger for the
negligent acts of the ship's doctor in performing his or her duties. Most cruise lines create the fiction that the doctor is an "independent contractor". This is true even though the ship's doctor may wear the same uniform as the other ship's officers. The carrier, however, is liable if you can show a failure to exercise reasonable care in providing a qualified and competent doctor or for not supplying the doctor with proper equipment.
