Can I bring suit against a third party, not my employer, under the Longshore and Harbor Workers Compensation Act (LHWCA)?

Yes. A person covered under the LHWCA may sue a third party that is not his employer or co-worker for negligence of that third party which caused injury or death to the worker. This type of suit is similar to third party claims where state workers compensation laws apply.
