Can I rely on the NTSB investigation report to prove the cause of an accident?

While courts differ on what portions of the NTSB Report are admissible in court, it is commonly held that the NTSB's conclusions regarding causation are not. Additionally, the NTSB is not an advocate for plaintiffs or defendants. For these reasons, it is important for you to conduct your own investigation to determine the cause of an accident. Certainly, the NTSB's work will be of great importance, but it is not sufficient on its own. Conducting your investigation with the assistance of an experienced aviation attorney gives you the benefit of that attorney's knowledge as well as the protection of the attorney-client privilege.
