Will the SEC release information on a pending investigation of a company?

The quick answer: no. The SEC conducts all of its investigations on a confidential basis for two main reasons:

(1) the SEC conducts investigations more effectively if they are not announced publicly. For instance, important documents and evidence can be destroyed quickly if people hear of an investigation and

(2) investigations are kept confidential to protect the reputations of companies and individuals if the SEC finds no wrongdoing or decides not to bring an action against them.

Though this is frustrating, this policy protects the integrity of the agency's investigative process and preserves the privacy of the individuals and entities involved. As a result, the SEC can neither confirm nor deny the existence of any investigation. That means you won't find updates or status reports on pending investigations on its website, and you can't get them by calling or writing.

Once the SEC files an action in court or in its internal administrative process, you can find information about public enforcement actions on its website.
