How is the lawyer reimbursed?
In a typical wrongful death action, the attorney agrees to take a percentage of the monetary recovery he or she ultimately obtains for you as a result of negotiation or trial. The actual percentage a lawyer takes is generally between 20% and 50% and may be limited by statute. If the lawyer does not win he or she gets nothing. This is called a "contingency fee".
