What is reformation? |
 |
| Reformation is an equitable remedy in which a court modifies or revises a contract, deed, or other written instrument to make it conform to what the parties understood or agreed to. Reformation is most likely to occur when the parties have entered into a binding agreement and some related writing does not conform to their agreement, either due to mistake or fraud. For example, if you agreed to sell two acres of land and the deed you deliver covers only 1.5 acres, the court would likely reform the deed to cover the full two acres. |
