The authorities are trying to take away my license. This is a job-killer for me! What can I expect to happen?

It certainly can be nightmarish, especially when the enforcement agency closes your operation down. If you are in this situation, it is ESSENTIAL that you consult with an attorney immediately to defend against partial or full loss of your license. This could be an uphill battle.

There is a process in place for appealing such action, but, as the licensing laws may be enforced by any number of government officials, and overlap, there is the built-in problem: there are wide variations in the ways in which administrative officials interpret the grounds for suspension at a given moment. The actual process varies, not to speak of the confusion between differing enforcement agencies. The matter may be subject to critical review, especially if the proposed suspension/revocation is in response to complaints received from the public, criminal action, disciplinary actions, flagrant violations, and so forth. Some involve limited review, such as those involving correcting small violations (e.g., not fulfilling all the regulatory requirements for licensure). Depending on the severity of the matter, you may be facing hefty penalties, on a per-day or per-violation basis, or, worse, complete loss of license to operate.

Your first step is ask questions and review the reason for the proposed suspension (or revocation). Contact the proper licensing authority and ask for a copy of the suspension and appeal process that governs your situation. Your second step is to attempt resolution with the licensing authority. If the matter cannot be resolved at this stage, attend the agency’s revocation or suspension proceeding where your case and rights will be reviewed and a decision rendered. If you lose at this level, you can take your case to court.
