General Practice - Suing Being Sued - General Questions

What are my options?
Depending on the laws in your state and the nature of the suit, typically your options are:

(1) find out what resolution the claimant really wants (e.g. an apology),

(2) see if the claim is covered by insurance,

(3) make an out-of-court settlement,

(4) formally answer or allow a default,

(5) defend - vigorously ("scorched earth") or mildly (sometimes to "buy time"),

(6) counter claim - you sue back,

(7) try using various alternate dispute resolution procedures (e.g., mediation, arbitration),

(8) consider bankruptcy (which "stays" the litigation),

(9) not show up at the trial. In this case, the judge is likely to order a default judgment against you – in other words, the other side wins.
