I took some codeine cough syrup and then got arrested for drunk driving. The blood test showed the codeine, but the alcohol level was not high enough to be a problem. They still charged me with driving under the influence. Should I fight it or plead? |

The answer to that question will depend on many more factors, so you need to consult a lawyer in detail. However, in most states driving under the influence of illegal drugs is the same as driving under the influence of alcohol. This is a situation in which it is best to always opt for the breath test. However, you don’t necessarily lose. Tell an attorney the whole story and answer his or her questions. Maybe you weren’t under the influence of the codeine even though it was in your blood. Laws differ on this issue from state to state. Don’t make the mistake of picking out one fact and letting it determine your case.
