Can the owner/operator of a polluted facility escape liability?

If the spill results from an act of God, an act of war, or an act or omission of a third party the owner or operator sometimes may escape liability for causing environmental contamination. The assistance of a skilled lawyer will be necessary however, as the land owner / operator will have the burden for proving that the pollution was not his/her/its fault.
