My boyfriend and I never married but he fathered both of our children. His name was never entered on the birth certificate. Since his unexpected death, his family and I have been trying unsuccessfully to get his name on the birth certificate and file for social security benefits. How do we go about this?

Our recommendation is to file a petition (with his family joining in) in family/superior court to determine paternity. If his parents and/or siblings are living, a DNA test can determine whether he is likely to be the father. The court will enter an order of paternity and you can then change the birth certificates and file for SSI benefits.
