Does an employer have to offer employees benefits, such as vacations, health plans, pension, etc.? |

| Generally, there are no laws which require an employer to provide employees with fringe benefits, such as vacations, sick leave, health insurance, pensions or profit-sharing plans. As with a probationary period, an employer may create different benefits for different employees (within any limitations dictated by state or federal law, such as rules governing 401(k) plans, SEP’s, and Simple IRA’s). However, differential benefits that cannot be justified by legitimate business considerations may expose an employer to a claim of discrimination. |
