Blue Cross Class Action—How Does This Affect My Rights?
The Blue Cross class action is a class action filed on behalf of everyone who had their individual health care policy rescinded by Blue Cross since late 2001. The way a class action works is that everyone who qualifies for the class is automatically included in it. In this case everyone who qualifies for the class will be notified of the proposed settlement with Blue Cross, and anyone who doesn’t want to accept the settlement in his or her case can opt out and file a separate action. If you don’t opt out you will be included, and you will be limited to the damages agreed to in the class action settlement.
There are several kinds of damages people might have suffered that are not covered in the proposed class action settlement with Blue Cross. See Blue Cross Class Action—Should I Join the Class or Sue Individually? for a discussion of other damages. If you have suffered any of those damages and don’t take action to opt out of the class action, you will lose those the right to claim for those damages at a later date.

It’s a good idea to consult with an experienced insurance litigation attorney to have your case evaluated. Insurance bad faith is a very specialized area of law and, like all specialized areas, it should be left to those who know what they are doing. This isn’t the kind of case you can handle yourself or where you’d be advised to hire an attorney who isn’t familiar with insurance bad faith litigation. It isn’t easy to deal with the well-funded and experienced lawyers hired by Blue Cross. Whether you go to trial or settle, an experienced attorney will almost always be able to get you better result. You may opt out of the class action by the date specified in the letter and will receive notification of the class action settlement in order to preserve your rights to other damages.
If you want to remain part of the class you don’t have to do anything. You are already a member if your individual health care policy was rescinded at some time since late 2001. You will only need to follow the instructions you will receive on how to collect your damages and have your case reviewed.
