Blue Cross and Blue Shield Policy Cancellation Practices Disproportionately Targets Individual/Independent Policies

Recent lawsuits filed in California have accused Blue Cross and Blue Shield of violating laws that prohibit the cancellation of health insurance policies on grounds other than willful misrepresentation on the part of the person applying for insurance. These cancellation practices affect only the self-employed or those who don’t have medical benefits as part of their employment. This is because California law requires the insurance companies to insure any employee under an employer’s policy, but allows insurance companies to reject people who apply for coverage as individuals or part of a family group.

More than 2 million Californians now purchase their own insurance policies and many more have no medical coverage through employment. As medical insurance costs rise, more employers are dropping medical coverage, making policy cancellation practices important to an increasing number of California residents.

California has a Major Risk Medical Insurance Program (MRMIP) that is supposed to provide temporary medical coverage for people who can’t get insurance directly from private companies. Within the 36 months that they are covered by MRMIP the people insured are guaranteed coverage from a private company at a cost of just 10% more than the MRMIP premiums. Unfortunately, the program has a long waiting list, leaving many Californians uninsured and often unable to afford medical care during the wait.
