Don't we have an insurance department that will help me if my claim is denied?
Yes, all states have a Department of Insurance or something similar, and you can make a complaint to them about your claim. Unfortunately, the Insurance Department is very busy, does not follow up every complaint, and defers action on most complaints to the Courts.
Do not expect the Department of Insurance to intercede favorably on your behalf (it rarely does). Never wait to pursue your claim, including any "appeal" of the claim denial, or defer considering filing a lawsuit when and if the appeal is denied, simply because you are waiting for the Insurance Department. You may never get a response from the Insurance Department, or the response may not be particularly helpful, and you may have allowed one or more statutes of limitations to run, which could mean you would be out of luck. |
