What are the common problems arising from content?

Content, or material that is transmitted to an audience through any one of a variety of methods, is subject to multiple complex rules and regulations. The use and transmission of content may result in various issues and problems that can quickly create legal complications for both the author and the owner of the content and for those making use of the content.

A few common problems related to content and its usage are outlined below:

Copyright Laws

Copyright is the most common problem when it comes to content and its use. Free content is content that is available for free public use and that which is considered “public domain.” Any content not considered free is still owned by its creator and thus he or she has the right to use it, while others must ask permission before reprinting it or otherwise transmitting it. Reproduction of content without permission is a copyright violation.

Trademark Laws

Similar to copyright laws, trademark laws also center around the usage of content that belongs to someone else who has not given you permission to use it. In the case of a trademark, the specific type of content in question is a symbol, mark, or image.

Libel/Slander Laws

Certain types of content that may be false and damaging to others can be considered libel or slander, and the use of such content can open you up to lawsuits from the party in question.

Patent Laws

Content in the form of inventions and ideas may be patented in order to limit its use to its creator and/or owner. Use of patented content, ideas, and information without permission is a violation of the law.
