How many judges hear each appeal in federal court?
The number of Federal judges in each circuit varies, depending primarily on how many cases are generated by the geographical area each serves. Three judges normally are assigned to decide each appeal. If two of the three judges agree, that becomes the decision of the Court of Appeals. Very rarely, the Court of Appeals will grant a motion for rehearing (by the same three judges) or a rehearing "en banc", by all or most of the active judges on that particular Circuit Court of Appeals.
