An attorney I hired in my criminal proceeding spent only a few minutes with me prior to trial, called me by the wrong name in court, and accepted a juror against my wishes. I was found guilty. Can I sue the attorney for malpractice?
You may be able to appeal the verdict on the basis of ineffective assistance of counsel. And if the lawyer only did a few hours work on your case, the bar association may say the fees were unconscionable and require a refund. In an action for malpractice, you would have to show that you likely would not have been found guilty if not for the actions of the lawyer, often a difficult claim to prove.
