I just know something is not right at my dad’s nursing home. What can I do if I suspect nursing home abuse or neglect?
Given that your dad’s health and safety is at risk if nursing home abuse or neglect is suspected, your suspicions should be investigated immediately. Talk to your dad’s nursing staff, as well as anyone else at the facility who is in the position to witness your dad’s care. Request copies of all records related to his care, and ask for any other documentation that the nursing home can provide. If you are not convinced that the nursing home is taking proper care of your dad, bring your concerns to the attention of the nursing home administrator. It will generally be necessary that your dad has suffered some type of injury as the result of poor care, either physical or emotional, to successfully bring a claim against the nursing home. You might also want to seek the assistance of an attorney who is experienced with nursing home cases to help decide whether or not your dad has a claim.
Once an attorney is involved, he or she can review all available records and take formal, sworn statements, or “depositions,” of the nursing home staff and administration to find out if the elements of a legal claim exist given the circumstances. When it looks like your dad is likely to have a claim, the attorney will continue to investigate the facts specific to your dad’s care and establish by reviewing the laws and the standards that other comparable nursing homes use to determine that your dad’s care is substandard, and that his injury is directly related to this substandard care. |
