Texas Texas has three types of courts which handle probate cases, depending on each county's law: County Courts at Law, Constitutional County Courts, and specialized Probate Courts. In some counties, more than one court has jurisdiction over probate matters. Generally, if a (constitutional) county court has jurisdiction over probate, the district court will have jurisdiction and oversight over contested matters. In this case, contact the county clerk, who also serves as the clerk to the county court.
