Can the Department of Insurance make my insurance company pay my claim?

All states have a Department of Insurance or something similar. You can file a complaint with that department if your insurance claim is denied or delayed. Unfortunately, most Insurance Departments are busy and fail to follow up on every complaint, often deferring action on most complaints to the courts.

Do not expect the Department of Insurance to intercede on your behalf (it rarely does). Never wait for the insurance department to act before you pursue your claim. This includes any "appeal" of the claim denial or filing a bad faith lawsuit when and if the appeal is denied, simply because you heard from the Insurance Department. You may never get a response from the Insurance Department, the response may not be particularly helpful, and you may have allowed one or more statutes of limitations to run, which could mean you are out of luck.
